He said: I started my work here in KSA Nov. 29 2003 and I get already 2 vacation and this is my fifth year and I file my resignation. I didn’t sign any contract except for the first contract 2yrs that I already fulfilled last 2003 end of 2005 Nov. and I just extend until now and I plan to go to Nov. 29 2008 the exact finish of my eqama and exactly 1 yr me already here since vacation last December. I inform already our personnel  not renew my iqama. Then I call labor law of Al khobar then they told me that the company will pay my ticket for one way to Philippines. Just I need a big help to have a copy of that article that mention the company will shoulder of that ticket. Please can you email me as soon as possible.

Reply:

There are 2 types of contract a) Specified Contract and 2) Unspecified Contract.

A labor contract concluded for a specified period shall terminate upon the expiry of its term. If both parties continue to enforce the contract thereafter (in the absence of new contract) it shall be considered renewed for an unspecified period. (Art. 75-76, NSLL).

If the contract is for an unspecified period, either party may cancel it for a valid reason, subject to giving the other party a (30) thirty day prior notice in respect of workman employed at a monthly rate. (Art. 75-76, NSLL).

With regards to your air ticket, please note that you signed a contract for 2 Years based on your letter above. I just want to make a correction, it seems that you arrived in the Kingdom Year 2001, considering that you spent 2 vacations for the past 5 Years. Am I correct?

If I am correct, your employment with the company is in unspecified period, meaning an automatic renewal of contract.

Now, Al Khobar Labor office is right, the company will provide you an air ticket back to your country of origin, only if they accept your resignation and willing to shoulder your air ticket. Please note that you are employed in unspecified contract in which you are oblige to finish the remaining  year(s) of your employment with your employer to complete the 2 Years contract.

However, if your employer accept your resignation but refuse to shoulder your air ticket, then they have the right not to provide you an air ticket.  

The law is silent with respect to air tickets, therefore we must be aware of the condition written about the air ticket in our contract. What the law requires is that the employer should bear the cost of air ticket on final leave at the end of the worker’s contract (exit visa).

However, it seems that you have a 2 year contract (unspecified) so it means you have still remaining 1 year to finish your contract. In this case, you must bear the cost of your ticket,  if they refuse to provide it. However if you have good record with the company, maybe the company will bear the cost of your air ticket upon your request. Remember, for unspecified period of contract, either party may cancel it for a valid reason. (Chapter IV-Leaves, NSLL).

Sir,nagsearch po ako online to seek help & im glad na napunta ako dito sa page mo. dalawa po kaming pinatigil sa trabaho ng kompanya at pina fill-up ng exit form last feb 28 2010 sa dahilan ng complaint namin sa hindi pagsunod ng kompanya sa kontrata. Bago lang po kami dito sa KSA at nong Nov. 4 2009 lang nagstart sa work, bali 4 months lang yung work period namin. Ngayon isang buwan na po kaming naghihintay at hindi pa rin naibigay ang papers namin pauwi. sabi ng kompanya na shoulder daw namin ang ticket pauwi at pumayag na kami dun para makauwi lang, pero ng tinawagan namin ang recruiting agency sa pinas sabi nila dapat ang kompanya daw ang mag shoulder sa ticket. Sabi ng agency tatawagan daw nila ang kompanya dito to solve the issue kaso hanggang ngayon wla pa ring masagot na resulta.

    Ask ko lang po sa inyo sino ba talaga ang obligado magbabayad sa ticket namin? At obligado ba kaming magbayad sa sinasabing visa, iqama, at medical insurance? Sa ngayon pinahold din ng kompanya ang sweldo namin from dec2009-feb2010, at nauubusan na rin kami ng pera panggastos. Hindi rin po kami nagtungo sa POLO.

  2. i read about air ticket issues..just wanna ask about a case regarding about it..i finished my contract last november 1,2009 but i continued to work until novembr 30 of the same year without signing any contract..basically i didnt renew any contract and my employer decided to stopped me from work just this 1st of december and planned to send me back in the philippines but unfortunately until now i am still here in the kingdom and they failed to send me back home..i’ve been waiting for my plane ticket for 15 days now..i talked to my employer but according to him it is peak season that’s why they cant book me..i already suggessted some airlines with flight schedule suitable for my leaving but he refused those because of the high price..do i have the right to demand now after my long time of waiting?its been 15 days and i cant wait for another more weeks..what i shall i do now?is there any law regarding this matter?thank you so much…

      una sa lahat, salamat sa pagbisita sa blog.

      pareho kayo ng problema.

      wala sa saudi labor law na hindi ka papauwiin kung ayaw mo ng magtrabaho or mag exit ka na. ayon sayo, stop work kana last october 2009, it means approve ang application mo or notice to stop work or notice for cancellation of contract. not unless kung hinihintay ang iyong kapalit, sa rason na ito ay mayron silang karapatan na hindi ka pa pauwiin. sa aking karanasan pinakahaba na ang 3 buwang paghihintay (habang akoy nagpatuloy sa pag work) pero sa kaso mo na stop to work ka na, maliwang na hindi na kailangan ang iyong kapalit.

      isa pa dapat pinag trabaho ka muna ng kompanya upang matustusan ang mga buwan ng iyong paghihintay.

      tungkol sa ticket, totoo ang kanilang sinasabi na mahirap mag booking sa buwan ng december na kung kung saan peak season, pero gaya ng sabi mo problema na nila yon.

      sa aking tantiya iniipit ka nga ng iyong employer. sa kadahilanan na ikaw lang ang nakakaalam.

      hi mr bong amora,

      hi!sir gud day! im iandean toledo.working here in al hokair group of companies here in khobar branch.nag search ako sa internet sa inyong culumn to ask advice or some help with my problem..i finish my 2 yrs contract last oct 31.2009.it means stop to work na po ako. and notice ng company nmin 1month pa after before they send me home( phillippines).but the problem is until now sir hndi pa ako nakakauwi and the worse is hndi nmn bayad ng company yung upa ko sa bahay..and sa daily allowance ko that time na stop na ako sa work sa company..ask lang po..nakasaad po ba sa saudi labor law na kelangan bang mag stay pa ako ng ganun katagal before they send me back home..

      pls.give me a little advice lang po if ano po ang gagawin ko.sabi pa nga po sa hr department nmin na mahirap daw mag pa book ngeon dec.peak holidays daw..but its not my problem..di sana dapat noong nov.palang nagpA book na sila para nakauwi na ako.by the way sir..exit po yung file ko sa company nmin.maybe iniipit po cguro ang paguwi ko..and besides may mga mag vavacation nauna pa sila nakauwi kesa sa akin..unfair nmn po yun sa side ko..thnk you sir if ano po ang magiging suggestions or tulong nyo po para masulusyunan po ang problema kung ito..more power….

      • sir, is there any chance that i could demand now regardless of the price of the plane ticket? i’m afraid they will wait until the price gets down to its original price and that would be on January. hindi po praktikal para sa akin n nandito ako naghihintay sa pagbaba ng presyo sa kadahilanang wala nmn po silang ibinibigay na food allowance man lang sana..

    My contract will expire in May 2010 and I want to go on exit. If I don’t have a NOC, can I comeback to Saudi on another employer and how many months should I comeback. By the way I have the latest passport which is machine readable and already done with fingerprinting. Also I comeback in other city and not in my previous city where I worked.

    • Hi Dense! You can come back without NOC. Just make sure na ang business ng bago mong employer ay hindi katulad ng nature of business ng dati mong sponsor. Meron ding mga employer na bago ka mag exit pinapipirma ang isang ofw ng “promissory note” stating that you will not comeback to KSA in an specified months or year ngunit mas marami ang hindi gumagawa ng ganitong pamamaraan. Natatakot kasi sila na pag bumalik ka — sa kanilang rival company ka maninilbihan.

      Tungkol naman sa fingerprinting, walang problema yan not unless kung may criminal case na nakasampa o na i-file sa iyo.

      Tungkol naman sa passport, in my own experience, naka tatlo na ako ng employer mula 1993, at sa tatlong employer na iyan, 3 rin ang naging pasaporte ko.

      Isangguni ang iyong mga katanongan sa iyong employment agency sa pinas sa karagdagang kasagotan ng iyong mga tanong.

  4. Gusto ko lang po malaman kung ang pagkakaintindi ko sa probisyon ng Saudi Labor Law hinggil sa NOC ay tama. Wala naman po akong masumpungan na salitang no-objection certificate sa SLL.

    Ngunit sa Article 83 ay may nakasaad na ang employer ay may karapatan na hindi payagan ang manggagawa na magtrabaho sa kakumpitensiyang kumpanya na hindi lalampas sa dalawang taon. Subalit para ito ay maging ganap, kinakailangan na ang pagtatakda nito ay, UNA: dapat ito ay nakasulat o itinakda sa kontrata [katulad ng “the worker shall not compete with the employer or reveal his (employer) secrets upon expiration of the contract”]; at PANGALAWA: para magkaroon ng bisa o maging valid, ito ay dapat na nakasulat at nakasaad ang oras, lugar at uri ng trabaho.

    Tama po ang aking pagkakaintindi? Kung mali po, humihingi po ako ng inyong payo, yayamang ako po walong buwan palang po akong nagtratrabaho dito sa Saudi.

      My apology for late reply. Yes you are right, the NSLL did not mention anything about NOC. Likewise, the Memorandum issued by Royal Embassy of KSA dated 3 April, 2007 did not mention about NOC. It only stated that the old passports will have to be submitted.

      Please allow me to paste below Article 83 of NSLL for everybody’s info. It says:

      “If the work assigned to the worker allows him to get acquainted with the employer’s customers, or to have access to his business secrets, the employer may require the worker in the contract not to compete with him or reveal his secrets upon expiration of the contract. For this condition to be valid, it shall be in writing and specific in terms of time, place and type of work and to the extent required to protect the legitimate interests of the employer. In all cases, the duration of such agreement shall not exceed two years from the date of termination of the relationship between the two parties”

      Also find below the important text of the Memorandum from Royal Embassy of KSA in Manila dated 3 April 2007.

      All Visa applicants except, household workers, family drivers, houseboy, baby sitter, family dressmaker, family cook, private nurse are required to submit their old passports if any; Visa pplicants without old passport are required to submit from the DFA certificate that the passport issued to them are their first.”

      Therefore, it is clear that the requirement is against the NSLL.

      That is why in my previous reply from our readers regarding NOC, is that only the recruitment Agency in the Philippines are asking for an NOC.

      Please note that the Memorandum was addressed to all recruitment agencies in Philippines.

      The recruitment agencies interpretation of the said memo are the following:

      If a worker has previously worked in the Kingdom of Saudi Arabia (KSA), a No Objection Certificate (NOC) from the worker’s previous Employers / Sponsors is required to be submitted to Saudi Embassy for visa stamping. If there is no NOC to be presented, a worker should wait for two (2) years prior to visa approval.”

      The recruitment agencies in Philippines also says that:

      “The resurgence of this requirement was precipitated by contract workers who pre-terminate their contracts with their Saudi Employers only to return later to Saudi Arabia using the visas of and get employment with the competitors of their recent or previous Employers / Sponsors.”

      However, if an OFW wants to come back in KSA with new employer, he must see to it that the nature of his job is not the same of that of his previous employer.

      Also be noted that not all companies/employers in KSA will give NOC to their departing/exit employees. Ngunit maraming employers/companies dito sa KSA na ni-require nila sa kanilang departing/exit employees ang pag pirma ng “promissory note” stating that he will not come back to KSA within 2 years.

      Sana nagkaroon ng liwanag sa iyo ang punto tungkol sa usapin ng NOC.

  5. so ibig sabihin depende sa agency yung NOC kung kaylangan o hinde?so kung halimbawa maka alis ako pabalik sa saudi na walang NOC,pagdating bah dito sa airport nang immigration inde bah nila hinaharang ang ofw na walang NOC.meron kc akong nabalitaan na hinaharang yung ofw na bumabalik na walang dala na NOC at pina uwi pabalik sa pinas.

  6. Roel, kausapin mo ang agency mo, sila kasi ang maglakad ng visa mo sa Saudi Embassy. Depende kasi sa recruitment agency, mayrong mga agency sa atin na ni-require ang noc para isumite sa saudi embassy. Sana hindi mahigpit ang agency mo para makabalik ka agad rito. Best wishes.

  8. Hi Roel! Thanks for dropping by…

    Fingerprinting is compulsory to all expats in the Kingdom, not only Filipinos. Pag na fingerprint kana at nagbakasyon ka sa atin, pagbalik mo dito hindi na ito kailangan sa immigration. Pero sa mga bagong dating na OFWs or nag change ng employer, ibig sabihin nag exit ka at bumalik ka with new Phil. passport and new employer, you have to undergo fingerprinting sa mismong immigration ng airport bago ka makalabas. if the company requires you to have your fingerprinting eventhough you filed exit, just comply the order, wala namang bayad ito.

    As what i understand, those expats who complied to the mentioned order and after that nag karoon siya ng criminal records or whatever act against their law and was able to elude arrest, return back home and back to ksa with false identity, etc, etc, timbog siya sa immigration palang kung mag match ang fingerprint nya.

    Lahat ng dokumento prior deployment dadaan sa Saudi Embassy na naka base sa atin sa pinas. They are the one asking for the Non Objection Certificate. You have the right to ask for an NOC but employers also have the right not to issue. Pero kung maganda at maayos naman ang mga naipakita mo sa kompanya, wala sigurong dahilan para hindi sila mag issue ng NOC.

    I have little question and make me confuse, regarding the finger print,
    i want to go exit this coming june 2009 my contract will be end that month,and my eqamma will be expired on july 23 2009,

    Sir if my Company refuse not to give an NOC?it is possible to come back here in other company after 3 months?
