New Labor law in the offing…..

JEDDAH: The Ministry of Labor unveiled a new bill that would unify contracts in the private sector along with a set of measures that are to be implemented in the future. The new set of measures aims to address workplace relations between the employee and the employer in the private sector.

The ministry’s new measures will focus on reducing labor disputes in the workplace, especially on payment issues. It will also address issues pertaining to job transfers, especially with regard to an employee seeking to change jobs.

The ministry also emphasized that the employment contract has to be made in duplicate with each party retaining a copy of the contract. The Ministry of Labor also said the new measures would include the caveat that no owner of a private sector company in Saudi Arabia’s shall be able to terminate an employee from service due to health problems. Also, the employees can now combine their annual leave to their sick leave.

Business owners will now be required to furnish their employees and workers the termination letter before the actual firing occurs. No owner shall transfer their employees to another location without the employee’s prior knowledge unless it is expressly written into the contract and signed by both parties.

The new bill states that an employee has the right to leave the job if there are any contractual violations, if the employer fails to pay the employee’s salary or subjects a worker to abuse.

Some measures are aimed at streamlining payment of salaries. The Ministry of Labor now states that an employer shall not change their employee’s status from a monthly-based salary to an hourly or daily wage without the employee’s agreement.

The bill also affirms the business owner’s rights to terminate the contract of their workers without compensation in cases of assault or fraud. Employers can terminate employees for disclosing company secrets.

  1. ilang days ba dapat mk uwi na ang ofw from time of exit date(stopwork)my end of contract is nov.15,theres no other issue except that i am still here and i am more than 1 month standby on my room w/my own expense,more than 15 days process ng papers ko after that when december comes in they said no available ticket,do we have a right about this situation?until now i still don’t have schedule

      Matanong kita, sino ang nag pa stop work sa iyo? Company ba? or ikaw mismo.

      Kung pinahinto ka sa work dapat lamang na asikasohin nila kaagad ang iyong pag-alis. Madali lang naman ang pag asikaso sa exit papers, maliban sa availability ng tiket, na kung saan sa buwan ng December ay halos fully book ang mga airline. You must follow it up, may karapatan kang gawin ito ngunit idaan sa mahabang pasensya dahil tayo ay may kailangan and besides pagsakay mo ng eroplano, FREE ka na. Please note that working in KSA is under sponsorship system where expats are at the mercy of their employer at walang ibang maka pagbigay sa iyo ng exit clearance, kundi employer mo lamang.

      Follow-up mo lagi, huwag lang idaan sa init ng ulo, alam ko Pasko ngayon at nais mong makapiling ang iyong mahal sa buhay ngunit hindi natin hawak ang barahang Alas, ito ay nasa kanila.

    Sa dalawang taong kontrata at naka isang taon ng nagtratrabaho dito sa jeddah, pwede bang mag resign?

    Kung mag file ng resignation at hindi pumayag ang amo, ano ang pwedeng gawin?

      Puwede kang mag resign bakit hindi. Pero mag expect ka na ikaw ay pagbabayarin ng employer dahil hindi mo tinapos ang kontrata. He will ask for compensation of all the expenses incurred in getting you from Phil to KSA.

      Article (77):
      If the contract is terminated for an invalid reason, the party who is harmed by such termination shall be entitled to indemnity to be assessed by the Commission for the Settlement of Labor Disputes, taking into account the termination circumstances and actual and potential material and moral damages sustained.

      You must have a valid reason para maaprobahan ang iyong pag-uwi. Kausapin mo ng maayos at sa mahinahon na pamamaraan ang iyong employer para pauwiin ka.

      Mag submit ka muna ng resignation para malaman natin kung papayag ba o hindi.

  4. 2 yrs lang po ang contract ko, tapos nag file ako ng exit hind po inapproved ung unang file ko, then nagfle po ako ng vacation approved n ,pero wala nmn po ako pinipirmahan pang contact bn bago, tuloy tuloy n pob ung contract ko mula nung una ,kasi po mahigit 2 yrs n ko now hind p ko nakakapagbakasyon mula ng ng 2008, gusto ko na po umuwi, sana po any matulungan nyoako,maraming salamat po

      Kung nag-apply ka ng bakasyon at na aprob at wala kang bagong kontrata, ibig sabihin noon ang bago mong kontrata ay magtatapos sa expiration ng bago mong iqama.

      Sabi mo nawala ang iyong iqama at inasikaso na ng iyong employer, pag meron ka ng bagong iqama, tingnan mo ang expiration nito at doon ka magbasi kung kailan matapos ang inyong kontrata.

  5. lost iqama po ako, at ang schedule ko po vacation ay nov 28 hind po ako natuloy dahil wala po ang iqama ko, ilang araw po lalakarin ang lost iqama para makauwi ako ng pinas ngaun, gusto kon pong umuwi, kanino po b ako pwede lumapit para sa problema ko, paki send nmn po sana s email ko kung kanino at cno po ang pwede ko lapitan para po makauwi ako, maraming salamat po

      Ang lost iqama ay medyo may katagalan at dapat lamang na kausapin mo ang iyong employer na trabahoin ito dahil sila lang ang makatulong sa iyo kung tungkol sa pagkuha uli ng bagong iqama. Isa pa, dapat may iqama ka bago makakuha ng exit or re-entry visa.

Tanong ko lng sir yong labor law tungkol s overtime.Dati yong friday namin x2 ngayon ginawa ng 1.5 sabi nila yon daw ang nakalagay sa labor law.Ngayon yong normal overtime nmin dati x1.5 ngayon gagawin n lng x1.makatwiran ho ba ito at ito ba ay naaayon s saudi labor law.Tama ho b n hindi kami bigyan ng payslip?

      Workers must receive time and a half overtime salary, thats what the law says, it means a worker get half of the hourly salary as overtime on top of the basic hourly salary. Calculation should be: multiply your hourly wage by 1.5 to determine your overtime hourly wage.

      The Saudi Labor says: The maximum overtime hours allowed per year shall be determined by a decision of the Minister.

      Article 107: 1. The employer shall pay the worker for overtime working hours an additional amount equal to the hourly wage plus 50% of his basic wage.
      Article 107: 2. If the firm is operated on the basis of weekly working hours, the hours in excess of the hours taken as the criterion shall be deemed overtime hours.
      Article 107: 3. All working hours performed during holidays and Eids shall be deemed overtime hours.

      Easiest Translation:

      The maximum limit of overtime hours allowed per year shall be determined by a decision of the Minister.

      Article 107:
      1- The employer shall pay the workman overtime work premium equal to the hourly rate plus 50% of his basic pay.
      2- If the establishment is operated on the basis of weekly working hour criterion, the hours worked in excess of the hours designated for this criterion shall be treated as overtime hours.
      3- All working hours performed during official holidays shall be considered overtime hours.

      Ngayon, tungkol sa iyong tanong, 1.5 lamang ang nakasaad sa batas at hindi 2.

      Pangalawang tanong: Hindi dapat magtrabaho ang manggagawa ng mahigit walong oras sa isang iraw, o mahigit 48 oras sa isang linggo. Sa batas ng Saudi, pag nagtrabaho ang isang worker ng lagpas sa nababanggit na oras, ito ay overtime na. Dahil ito ay overtime na dapat lamang nabayaran ang worker ayon sa nakasaad sa batas paggawa ng kaharian, ibig sabihin dapat lamang sundin ng inyong kompanya ang batas and you should be paid at time-and-a-half (1.5) as overtime pay and not 1.

      Sa payslip, ang batas ay naka “silent” tungkol dito. Ngunit may karapatan na hingin ito ng isang worker sa accounting department upang malaman ang detalye ng mga nakapaloob na sweldo ayon sa kanilang natatanggap. Puwedeng hingin ang monthly print-outs nito sa accounting department. Kung ayaw magbigay, mag complain diretso sa Saudi Labor Office.

  7. I finish ny contract last Octopber 01, 2010, I went to hospital for medication, then when I comeback they force me to worked I refuse and surrender my iqama.

    • Ano status mo sa company ngayon Raf? If you don’t have any plan to renew your contract at least you inform your employer 2 months in advance before expiration of your contract. Kung kailangan pa ang serbisyo mo at wala ka pang kapalit, may karapatan ang iyong employer to retain or extend you in a certain period of time. Pag gusto pa niyang ma extend ka (second time around), puwede parin BUT ngunit with your consent. Just make sure that you inform your HR or employer that you don’t wish to renew your contract even if your employer renew your iqama. To make sure, make it in writing.

      ESB calculation is based on the last monthly wage of the worker, it means SAR 3,000.00 should be your LMW. Yes, you can but it depends sa inyong apg uusap ng iyong employer. Ask your demands for a yearly contract, if ever he approves then you can go vacation every year with 1 month paid vacation and free ticket back and forth. But you should do it in writing and retain a copy of the contract for your record.

      I think there is no uniform or bracket wages in Saudi Arabia per hour or law pertains to basic wages. Please visit Ministry of Labor web site and try to check if any.
