I am not a lawyer nor do I have influence in any Government offices in the Kingdom of Saudi Arabia and or Philippine offices abroad. I am not also a Philippine Government representative from the office of Philippine Overseas Labor Office (POLO/OWWA) or the Philippine Embassy.

You ask my opinion and my reply are expressed in good faith to the best of my knowledge and based on my own experience as an OFW in the Kingdom for almost 19 Years and as a Community Leader recognized by our Philippine Embassy and Philippine Overseas Labor Office (POLO) / Overseas Workers Welfare Administration (OWWA).

I take absolutely no responsibility for the consequences arising out of such opinion or views. That is why I am asking you to seek more exact and accurate guidance, information and advice from the Philippine Government authorized representative or offices abroad overseeing the plight of our fellow OFWs.

Saudi ministry of Labor revealed an intention of preparing a black list for local companies that do not pay its Employees on time. Ministry of Labor will not compromise with this issue because this issue is under the violation that against the Saudi Labor Policy.

The Ministry is working to completing, developing and applying Salary-paying Protection System that will make the facility paying its Employee through Money transaction. The Salary-paying Protection System will allow the Ministry of Labor and other related government authorities following up the salary paying process and observe any delay to deal with it immediately.

“The Ministry noticed a delay in giving the Employees their salary from some private sector companies. Labor policy punish such violation because salary is employee’s right.” - Dr. Mufarrij Al-Hagbani, Deputy Minister of Labour

1) When the sponsored expatriate traveled outside the Kingdom carrying exit and re-entry visa, the sponsor must revoke the Residence Permit of his sponsored and (secure) a page copy of his passport on which the exit and re-entry visa stamped on.

2) When the foreign worker failed to return back to KSA after two months; the sponsor must follow-up the Office of Jawazat on which the visa was issued to receive the Iqamah and to get a receipt from there containing retrieval of Iqamah to deposit it on the Iqamah file of the worker.

3) The office of the Jawasat or Saudi Passport Office will update the file status of the foreign worker, such as fingerprints and other personal information and forward the detailed information to the Saudi Immigration data base.

4) And if the sponsor got any information that his foreigner sponsored who he gave an Exit and Re-Entry Visa returned to the Kingdom, then he must report it to the Office of Investigation and Tracking Foreigners for necessary legal action.

AGAINST RECRUITMENT AGENCIES

For violation of recruitment laws, rules and regulations

•overcharging of placement fee
•pre-mature collection of placement fee
•misrepresentation
•withholding of travel documents
•failure to deploy without valid reason
•failure to reimburse documentation expenses when deployment did not take place without the worker's fault
•substitution and alteration of employment contract

For offenses while working overseas:

•misappropriation of property or money of fellow worker entrusted for delivery
•creating trouble
•theft/robbery
•possession of deadly weapon
•drunkenness
•drug addiction, etc.

AGAINST FOREIGN EMPLOYERS

•Defaulting on their contractual obligation to the workers
•Violation of rules and regulations on overseas employment
•Grave misconduct

Philippine Embassy or Consulate nearest the jobsite of the worker

AGAINST RECRUITMENT AGENCY AND FOREIGN EMPLOYERS

•Money claims arising from employer-employee-relationship such as unpaid wages, breach of contract and illegal dismissal
