    i want to resign in my work now, ano ba ang consequences nito? 7 months pa lang po ako dito but i want to go home na po.

      Salamat sa pagbisita. Pasensya na at medyo abala lang sa trabaho.

      Kris, mahirap man bangitin ang mga consequences kung sakaling ituloy mo ang iyong plano, dapat lamang na malaman mo ito. Kung hindi mo taposin ang kontrata pagbabayarin ka ng iyong employer sa kanyang mga nagastos sa pagkuha sa iyo sa Pilipinas, kagaya ng Visa at Tiket, kasama na rin dito ang pag shoulder mo ng pamasahe pabalik sa atin ayon SLL Art. 40.2. Maari ka rin na pagbabayarin ng kaukulang halaga para sa damyos ayon sa SLL Art. 77 kung sakaling magraklamo ang iyong employer sa Commssion on Setllements and Labor Dispute.

      Pag-isipan mong mabuti ang iyong mga plano.

  2. Sir bong. Hello again.
    My husband is currently in Al-Qassim working as a nurse. He was deployed by (name of agency). The agency told him that his salary will be (amount) and he will be working in a hospital under MODA. He arrived in there last August and he was told (i think verbal and no written contract) by the HR that he will receive the same amount as what the agency told him though it is not a hospital but just a polyclinic under MODA. The salary was not given before because he has no Iqama and Saudi council yet. But he has his Iqama and Saudi council maybe 2 months ago. but until he now he didnt receive his salary yet. My husband already discussed this with the hospital director and HR. they promised that by the end of the month, he will receive his salary. however, the amount (monthly salary) my husband signed up for will not be the same. only half of it will be given. and his job title is only nurse technician. My husband raised this issue also to the agency and the agency advised him to just accept and tiisin na lang ung ganung sweldo. me and my husband cannot accept that. He signed the contract through that agency because the salary and work was favorable for us. Hindi na nga nasunod ung work setting, job title, pati salary ndi rin… delayed pa. He worked before in Madinah. And the salary they are giving him now is lower than what he was receiving before. and he is over qualified for the position they gave him now. what can we do about this? My husband has the translated (english)contract signed by DFA. But we are not sure if the MODA will accept/honor it coz there’s no signature of MODA. we are just very disappointed. lalo na dun sa agency for saying na tanggapin na lang yun. we paid the agency the full one month worth of the salary as processing fee before my husband left Pinas. The agency offered though, that they will return the excess amount but still… how can they do such a thing and leave you when problem arises?!

      Working in KSA or any country should not be done through verbal agreement. Sa lahat ng mga nais mangingibang bansa, dapat lamang na before kayo pumirma ng kontrata sa Pilipinas through your agency, you must have a copy of the job offer with the corresponding salary and other important terms and conditions such as: years of contract, salary per month, allowances (if any), job title, vacation (yearly or every 2 years) among others. The job offer ay galing po sa inyong recruitment agency signed by the manager or authorized officer of the agency. Kung meron kayo nito, puwede kayong magsampa ng kaso sa inyong agency kung sakaling hindi ito maibigay pagdating ninyo sa bansang inyong pagtatrabahoan.

      Tungkol sa problema ng iyong husband, anong translation ang iyong nabanggit, from arabic to english ba? If ever arabic ito at may letterhead ng MODA at nakasaad doon ang mga terms and conditions na hindi naibigay sa iyong husband at ito ay may english translation galing ng DFA, maaring ito ay ating magamit kung mag desisyon ang iyong husband na ireklamo ang MODA. Ngunit dapat munang isangguni ito sa POLO para malaman natin kung mayron tayong laban.

      Kung sakaling mag desisyon siyang magreklamo at gabayan or with POLO’s assistance, payo ko sa iyong husband huwag magbitiw or mag resign dahil puwedeng magkaroon ng paglilitis habang siyay nanilbihan pa or puwede siyang umalis sa employer na walang notisya or resignation ayon sa Artikulo 81 ng Batas Paggawa ng kaharian.

      Ngunit bago siya magdesisyon, dapat lamang na ito’y kanyang pag-iisipan ng mabuti at kaya niyang tanggapin ang consequences nito.

      Maraming agency pero hindi ko ito nilalahat, na pag sila ay nakatanggap na ng bayad sa aplikante or naka alis na ang OFW, wala na silang pakialam dito, sa madaling salita “hugas kamay”. Kaya nga ang tawag ko sa kanila “BUWAYA”. Kaya dapat lamang na bago umalis ang OFW mayron siyang mga dokumento na galing sa recruitment agency such as job offer dahil ito ay magamit sa panahon na ito ay kinakailangan. Kung tayong mga OFW ay walang laban sa labas ng bansa, may laban po tayo pag nakauwi na sa Pilipinas. May mga example po tayong mga kaso sa ating blog “OFW Cases Supreme Court Decisions”, makikita po ang pahinang ito sa bandang itaas ng ating blog.

      Paki pasa na lang sa akin ang name ng agency with corresponding contact details in my email addy at kung may scan documents ka sa kontrata na may DFA translation, please include it in your email, titingnan po natin ang dokumento.

  3. hi .. Good day. gusto ko lamang po malaman kung paano makakuha ng assistance sa Dammam Saudi Arabia sa kuya ko po na pwersahang pinag resign at di pinasahod. hindi nya po alam kung paano sya makakauwi.

  4. I had re entry visa in KSA but I was hired in UAE for much higher paying job. Is there any rules for re-entry/exit for GCC countries since I hear humors that if you had re-entry in KSA you cannot enter any GCC countries. Please clarify. Thanks

      It is not only rumors, isa o dalawa sa mga bisita sa blog natin ang nagsabi na ang kanaling kaibigan ay na hold sa airport at pinabalik sa atin. Pero wala pa akong nakitang black and white na kautusan or GCC rulings tungkol dito.

      Siguro ang best na gawin ay pumunta sa Royal Saudi Embassy na naka base sa atin upang itanong at kumuha narin ng kopya ng order kung meron man.

        Pano kong finish contract ako sir at gusto kong mag tourist visa sa UAE galing ng Dammam to Dubai eh hold karin nila dun sa UAE sir?anong requirements?.

        2nd question?
        Pano kong re-entry visa ako sir kasi ayw ako payagan nang company mag exit at gusto kong mag tourist visa ma hold din ako sa UAE sir?.anong requirents sir?

          Isa lang ang sagot, ang requirement: pahintulot or approval ng employer.

          Alin man sa dalawa kung papayag ang employer na dadaan ka ng UAE. Pero malabo.

          Pag Exit – Ang kontrata natin ay from the worker’s home country to KSA back to point of origin.

          Pag Re-entry – walang KSA employer na papayag na doon ka magbakasyon sa UAE. Kung meron man, napaka bihira nito, i mean one in a thousand.

          Kung ayaw kang pauwiin, mag complain ka sa Saudi Labor.

            How about end na yong contract ko dito sa company namen instead from Damman to Philippines travel ko, may possible kaya yong from Dammam to Dubai to Phils. visit visa lang gawin ko dun sa Dubai may dadaanan lang ako na kaibigan tutal siya nman mag sponsor sa akin.what to do?

            Nasa employer mo lang ang kasagotan ng tanong mo. Pag payagan ka na mag via Dubai, everything follows. All you have to do is to make a request and lets see their reply.

    this might be totally different from the topic above… ;p
    anyway, my saudi patient is asking what documents does her Filipino household help need if she goes back to Philippines for vacation and what else does she need to go back here. Im a new OFW (physiotherapist) so i really dont know what to say. The Saudi Patient told me that the household help was asking for OEC or something else… we really dont understand. I think the household help was an ex-OFW and returned here w/o the said document. Though she was stalled in the airport. But the household help said that she was only able to come back here because she lied to the officials in the airport and said that shejust forgot the document they are looking for.

      OFWs must have their OEC (Overseas Employment Certificate) for them to be able to come back to any country from vacation. This requirements are needed to help ensure that Filipino overseas workers (OFWs) are properly documented and protected. OFWs or Domestic Helpers or Household Service Workers must visit POEA office in their city or regional office of the province where they are located. Usually, POEA Bldg., housed all offices such as: OWWA, PAGIBIG, Philhealth Insurance, and other agencies that have concerns to OFWs.

      OFWs needs to have the following prior to her/his departure back to the foreign country he/she work as an OFW:

      1) Passport (Valid Re-entry Visa)
      2) Proof of OWWA valid membership USD 25.00 (renewable every two years)
      3) Proof of Philhealth membership payment (P900.00)
      4) POEA Processing Fee of P 100.00
      5) PAGIBIG Membership

      After having paid all of this requirements with corresponding receipts, the OFW will present it to the POEA window for the issuance of Overseas Employment Certificate. It will be then attach to the passport and should be presented to the Immigration counter at the airport prior to departure from the Philippines.

        bago lang po ako dito sa forum at naghikayat po akong maghanap kong saan ako maka hanap sa poblema ko regarding sa contact ko,sana po matulungan u po ako kasi matagal kuna tong inicip sa akin pagkakamali. ito po yong sitwasyon.

        Last Dec 3,2008 nakarating po ako dito sa saudi arabia.Ang contrata ko po na pinirmahan ko ay galing pa sa pinas ay 2 years,but nong dumating na ako dito sa pagkakaalam ko ay direct hired ako ang trabaho ko but yong pala ay agency lang kame dito ika nga rental lang kame sa ibang company.Akoy isang bagito pa dito sa saudi nuon at walang masyadong alam so yong employer ko lumipas ang ilang araw may binigay samin na another contract na hindi ko na pansin ang pagkakaalam ko ay contract lang.iba pala 4 years ang nakalagay tas hindi pa binigay sakin yong copya sa dala nang kaba ko naka pirma ako dun.Ask kulang po kong may laban ba ako sa employer ko kasi plano ko mag exit next year tapusin kulang yong 2 years ko.pano yong 4 years ko,?.may laban ba ako niyan?.kasi pagkakaalam ko hindi ako bibigyan ng exit at re-entry lang.sana po matulungan yo po ako bago ako maka punta sa employer namen para makipag sabayan sakanila.

          Ang una mong gawin ay kunin ang kopya ng sinasabi mong 4 yrs. contract na napirmahan mo. Wala tayong basihan kung wala ka ring kopya nito. Kung 4 yrs. nga ang napirmahan mo medyo alanganin tayong magreklamo dahil sinang-ayonan mo ito ayon sa ebidensya ng pirma mo.

          Pasyalan ang POLO at itanong kung may laban ka ba sa problema mo.

      You told me in your earlier letter that your employer is holding your iqama. So, he is liable for the penalty incurred for not renewing your iqama on time.

      Below are important notes for not renewing iqama on time:

      Non-reporting for Iqama renewal prior to 3 days of its expiry without a valid reason. The applicant’s employer , it may be individual or private company or establishment shall be required to pay double the Iqama fees.”

  6. di na po ako mapapaligoyligoy pa. di ko po nagugustuhan ang patakaran ng amo ko sa trabaho. unang una na ay ang hindi pagbigay sa amin ng dayoff na alam naman nating isang karapatan. sapilitan din kaming pinapapasok kahit kami ay may sakit. noong ako ay nagbakasyon noong ramadan, kinaltasan ako ng sahod.minsan ako ay naaksidente ay wala po akong natanggap na benefit kahit kinakaltasan kami para sa insurance.kinuha rin aking iqama at ayaw ipahawak sa akin.maari nyo po ba akong payuhan kung ano ang dapat gawin?

    I would like to ask po something outdated po ako sa OFW sa atin sa Pinas, im applying my friend here sa Singapore as WorkPass, and ive heard a rumour na, eventhough may Singapore-Work-VISA na ang isang Pinoy, hindi raw po pinalalabas ng Pilipinas due of bagong system? ano po ba ang latest? basically po direct hire po from Singapore…help naman po dyan.

    • Hi Jojo,

      As far as i know the Philippine Direct hiring regulations or guidelines is not only limited to Singapore but to all countries hiring Filipinos through what they called Direct Hiring. This guidelines was issued Year 2007 by the POEA in which foreign employers who wish to directly hire Filipinos to work in their country should be pre-qualified by the POEA and direct hiring employers should still need to submit a request to POLO to qualify to direct hire Filipinos in our country.

      I dont know if this guidelines or regulation is still existing but am sure if you are in Singapore right now, you can ask our Philippine Embassy on this issue and they will give you a concrete answer.

      All I can say is that – don’t let your friend come to Singapore to work without proper documentations issued from POEA or POLO/OWWA. This is for his own good.

  8. Magandang araw po! i just want to ask for advise reagrding in my present situation in my company. I have been working as Admin Secretary in one project of the company/agency holding me for nine (9) years at sa loob po ng taon na iyon ako po ay never na nabigyan ng memo o never po ako lumabag sa anumang rules ng aming kumpanya , but just last Saturday, i receive a letter from my Agency that they are transferring me to another project they said they have. i am very surprise because wala po akong nattandaan na i request for it at hindi po ako naabisuhan bago ang memo ng pag-transfer sa akin, tama po ba ang ginawa ng aking agency? that same day my Project Director po ay tumawag sa akin & i ask him if he requested for me, and he answer “Never i make request for you to transfer” so i was left hanging.. at gusto ko pong malaman nyo na until now 4days ay wla po akong tawag sa agency na ako po ay ililipat sa ibang project site. GUsto po sanang humingi ng payo kung ano po ang nararapat kong gawin at obvious po unfair po ang ginawa nila sa akin. Sa katunayan po ako po ay tumawag sa isang project manager at ang inaalok po sakin ay bilang isang cleaner, hindi po ba na dapat kun ako po ay ililipat ay dapat po ay parehong posisyon at sweldo? Tulungan nyo po ako mabigyan ng linaw ang aking sitwasyon. Salamat po!

      Hintayin mo ang formal notice of transfer kung mayron man. As of this time, you don’t have to worry and if ever there will be a notice for you transfer in a another project and with a different position you previously assigned, please note that the Saudi Labor Law says in PART V WORK RELATIONS, Chapter One
      Work contract Article (60); “Without prejudice to the provisions of Article (38) of this Law, a worker may not be assigned duties which are essentially different from the work agreed upon without his written consent, except in cases of necessity dictated by transient circumstances and for a period not exceeding thirty days a year.”

      Article 58 also says: “The employer may not transfer the worker from his original workplace to another place that entails a change in his place of residence, if such transfer is likely to cause serious harm to the worker and is not justified by the nature of work.” Please also read Art. 38 of SLL.

        Salamat po sa response, at medyo naliwanag ako pero maari pa ho bang magtanong. Kase sinubukan ko pong magtanong sa amin Company Project Director pero ang sinagot lang po nya sa akin eh pumunta ako sa isang Project Manager ng isang project nila at tingnan ko raw po kung ano ang available na work doon. Nagsabi rin po ako na gusto ko pumunta sa head office mismo namin pero ang sabi po ay bawal daw pumunta ang mga babae dun, pano po ba yan? Dapat po ba na maghintay nalang ako dito sa Villa kung may ibibigay silang Formal Transfer Letter? until when i should wait, bago ako mag punta sa Labor Office? Matatawag din bang Termination ung ginawa nila sa akin? Kasi nga wala naman talaga silang ready position para sa akin. Maari po ba akong mag demand na ibalik sa dati kong work, kung hindi po ako sang ayon sa trabaho na ibibigay nila? Gusto ko lang naman po na maayos ang aking pangalan kse po sa totoo lang nakkahiya po ang ginawa nila sa akin at iniisip po ng mga kasamahan ko na may ginawa akong palpak sa trabaho kse nga po biglaan ang pag alis sa akin. Pano po kung ang pauwiin (exit) po ako bigla ng company ko para lang tumahimik ako. Alam nyo kasi may posisyon po sa militar yung club director na nag alis sa kin sa trabaho. Kaya nga po medyo alinlangan ako. Pero desidido po ako na ipaglaban ang rights ko, dahil unfair po talaga ang ginawa nila sa akin. Pasensya na po sa marami kong tanong kse wala po talaga akong magawa sa ngayon, lalo na holiday matagal po ako tambay sa bahay, walang sweldo. if ever po ba umayaw ako sa work na binibigay nila dahil iba sa kontrata ko, may karapatan po sila na bigla nilang kunin ang aking Iqama kse un po madalas ang ginagawa nilang panakot sa mga staff. Salamat po uli wag po sana kayong mapagod sa pagbibigay ng linaw sa amin may mga suliranin.

          Pasensya na po at ako ay out of the country.

          Ito muna ang masasagot ko sa ngayon. Kung wala kang natatanggap na termination letter, ang ibig sabihin wala silang balak i-terminate ka. Kung wala kang kasalanan na ginawa at malinis ang iyong konsensya huwag mong intindihin ang mga naririnig mo or huwag kang mag-isip ng problema. Stay cool and ask His guidance. Kausapin mo ng masinsinan ang iyong manager tungkol dito para matuldokan ang lahat na bumabagabag sa iyo. At kung pauwiin kaman nila na ayon sa batas ng Paggawa at ibigay sa iyo ang dapat para sa iyo, kung ako ikaw, uuwi ako upang mabigyan ng katiwasayan ang iyong isipin. Maraming trabaho ang naghintay sa ibang bansa maliban sa Saudi ARabia.
