He said: I started my work here in KSA Nov. 29 2003 and I get already 2 vacation and this is my fifth year and I file my resignation. I didn’t sign any contract except for the first contract 2yrs that I already fulfilled last 2003 end of 2005 Nov. and I just extend until now and I plan to go to Nov. 29 2008 the exact finish of my eqama and exactly 1 yr me already here since vacation last December. I inform already our personnel  not renew my iqama. Then I call labor law of Al khobar then they told me that the company will pay my ticket for one way to Philippines. Just I need a big help to have a copy of that article that mention the company will shoulder of that ticket. Please can you email me as soon as possible.

Reply:

There are 2 types of contract a) Specified Contract and 2) Unspecified Contract.

A labor contract concluded for a specified period shall terminate upon the expiry of its term. If both parties continue to enforce the contract thereafter (in the absence of new contract) it shall be considered renewed for an unspecified period. (Art. 75-76, NSLL).

If the contract is for an unspecified period, either party may cancel it for a valid reason, subject to giving the other party a (30) thirty day prior notice in respect of workman employed at a monthly rate. (Art. 75-76, NSLL).

With regards to your air ticket, please note that you signed a contract for 2 Years based on your letter above. I just want to make a correction, it seems that you arrived in the Kingdom Year 2001, considering that you spent 2 vacations for the past 5 Years. Am I correct?

If I am correct, your employment with the company is in unspecified period, meaning an automatic renewal of contract.

Now, Al Khobar Labor office is right, the company will provide you an air ticket back to your country of origin, only if they accept your resignation and willing to shoulder your air ticket. Please note that you are employed in unspecified contract in which you are oblige to finish the remaining  year(s) of your employment with your employer to complete the 2 Years contract.

However, if your employer accept your resignation but refuse to shoulder your air ticket, then they have the right not to provide you an air ticket.  

The law is silent with respect to air tickets, therefore we must be aware of the condition written about the air ticket in our contract. What the law requires is that the employer should bear the cost of air ticket on final leave at the end of the worker’s contract (exit visa).

However, it seems that you have a 2 year contract (unspecified) so it means you have still remaining 1 year to finish your contract. In this case, you must bear the cost of your ticket,  if they refuse to provide it. However if you have good record with the company, maybe the company will bear the cost of your air ticket upon your request. Remember, for unspecified period of contract, either party may cancel it for a valid reason. (Chapter IV-Leaves, NSLL).

    Good Day!

    I have a problem regarding the requirements for my housing loan in the philippines which I applied and paid already an 18 months downpayment but the developer required me to complete the submission of my documents ( e.i., employment contracts, certificate of my monthly salary, and pay slips ) my status here in saudi arabia is unspicified contract working that means i have not signed contract here since i arrived here in kingdom. i have been working for seven years already and had gone through vacations 3 times already. How can I acquire contract from my employer? the housing developer will not turn over to me my unit although im already qualified because I already paid the said downpayment, if I will not submit those lacking documents. can you please advise me sir. Thanks.

    • Jun,

      Submit the old contract in your possession with the certificate of employment showing your latest salary and the year you started working with the company. Iyan ang ginawa ko noong nag apply ako for loan with Pagibig. Tatangapin nila ito at alam nila kung ano ang unspecified contract dito sa KSA.

    kumusta po kayo..tanong ko lang po kasi..finished na po kontrata ko last march 6,2009 for 3 yrs..and now mag 6 yrs na ako this coming march 6,2012 na po..ilang beses na ako nagpaalam na mag vacation pero di pa ako pinayagan until now..kasi daw walang kapalit..di ko naman kasalanan yon di ba…i have a right to ask my vacation leave..iba ang prinsipyo ng boss ko..pag sabing hindi hindi talaga ..nahihirapan na po ako d2 sir…ang tanong ko po..ano po ang matatanggap kong benifisyo if sakaling papayagan ako..for 6 yrs this coming march 2012…against the law na di ba ang company namin…sa hindi pagsunod sa nakasaad ayon sa saudi labor law….anu ang maganda kong gawin para matakot siya..at papa uwiin na po ako….saan po ako hihingi ng tulong tungkol po d2….,salamat po..

    • salamat po sir,,try ko po ilapit itong problema ko sa polo..pero sa pagkaka alam ko marami ng nagsumbong noon sa polo..but di rin nanalo..kaya umuwi ang mga naunang ofw na nagtrabaho dito sa pinapasukan kong kumpanya..na luhaan..di naibigay ang air ticket at benepisyo..ang iba umabot na ng 6 yrs gaya ko…kaya ito labis ikinatakot ko..baka uuwi din akong luhaan..please explain me for my 6 yrs work here in my company..anu po ang makukuha kong benipisyo at ni minsan di ako nakapag bakasyon..may pinirmahan akong kontrata sa pinas ..sa agency..2 yrs lang po…but pagdating namin dito binago ang kontrata ng saudi bossing ko..naging 3 yrs…and i think with out the stamp of chamber of commerce dito sa saudi..sa kanya lang yon..at di pa kami binigyan ng duplicate copy…ilang beses na ako nagmakaawa sa kanya..but sarili lang niya iniicip di niya iniisip na may pamilya din ako…hirap na talga ako dito…..

        Kung may basihan at laban ang reklamo bakit hindi nananalo ang mga complainant? Ito ba ay naisampa sa mismong Saudi Labor Office. DAhil kung sa POLO lang ito nakarating, hindi po ito sa korte naisampa. ang POLO ay mag mediate lamang kung ano ang mas magandang solusyon sa inyong problema through dialogue.

        Kung 6 years ka na diyan, puwede ka ng mag exit considering that if your contract is 3 years + 3 years = 6years. Ang matatangap mo na ESB ay kalkulahin sa tig-kalahati ng isang buwang sahod para sa unang 5 taon at tig-isang buwan sa mga sususnod pang mga taon. Ang ESB ay basi sa huling antas ng iyong sahod plus allowances.

        You are also entitled to compensation for unused vacation time, kung ang batas ang masusunod, ayon sa batas paggawa ito ay 21 days per year for the first 5 years and 30 days after that.

  3. opo my pinirmahan po sila… n nakasaad po dun na pag hindi po ako nakabalik ay sila po magbabayad sa mga nagastos po ng employer sa akin po… 3 years po kc ang contract namin at after 2 years ay magbabakasyon po.. eh sa totoo lang po eh ayw ko na pong bumalik.. anu po ba ang ang inyong suhestiyon?? sa tingin nyo po ba ay magbabayad po sila???

  4. gud morning po sir..hw r u?? im on my vacation po now sa phils at pauwi na po ako within 3 days..my tanong po sana ako tungkol po sa aking vacation, kasi po bago po ako pinauwi dito ay may garantor po ako n 3… pag hindi po ba ako babalik ay pababayarin daw po nila ang mga taong yun para sa akin.. how true po ba ang ganitong klaseng gawain? kasi po ang kompanya po namin ay napaka pangit po talaga..nurse nga po pala ako sa isang hindi magandang clinic…

  5. gud eve po sir..tnx po sa pgreply nu po sa aking mga katanungan… sir, mayroon po nakasulat sa contract nmn na gn2… A SECOND PARTY ENTITLES FOR A VACATION OF (__) DAYS AFTER HIS COMPLETION OF 12 MONTHS OF CONTINOUS WORK WITH THE FIRST PARTY WHEREAS THE 1ST PARTY DESERVES THE RIGHT TO SPECIFY THE DATE OF VACATION COMMENCEMENT IN ACCORDANCE WITH WORK SHEDULE…so anu po ang ibig sabihin nito. may mrreceive po ba kami na pera regarding these matter o wala po?? kasi po yung sister company namin ay nkakareceive sila ng 1100 as their annual vacation salary po… eh same lang po kami ng contract when we reach here magkaiba nga lang po kami ng administration eh… sir, looking forward po sa inyong reply! tnx mch….

      Ang nakasaad sa kontrata basi sa iyong sulat ay hindi po tungkol sa pera kundi tungkol po ito sa bakasyon. Ibig sabihin after 1 year puwede na po kayong magbakasyon ngunit kung maraming trabaho or kinakailangan ang serbisyo mo sa oras ng iyong bakasyon, ang kompanya ay may karapatan na kayo ay hingan ng palugit or extension bago aprobahan ang inyong request for vacation.

      Tungkol sa iyong tanong sa annual vacation salary, tama po kayo, dapat po na ma receive ninyo ito dahil ang ibig sabihin po nito ay kahit kayo nakabakasyon may bayad pa rin ito. Karapatan po ninyong hingin ito or dapat lang na ito ay ibigay sa inyo.

  6. sir gud aftrnoon po sa nu.. tanong ko lang po sana yung tungkol po sa 21 days n sick leave ay papanu po un m.aavail?? hindi po kc kmi llowed n mgsick leave eh kahit n myskit po kami…meron po kayang certain thing called as 21 days sick leave pay??? my habol po ba kami dun?? right po ba namin yun sir? thanks po talaga!

    • Chin,

      Wala pong 21 days sick leave baka naman 21 days annual leave. Bakasyon po ito na kung saan allowed lamang ng 21 days annually ang worker for vacation. Madagdagan ito ng 9 or 10 days = 30 days pag ikaw ay naka limang taon na sa iyong employer.

      Kung meron man kayong 21 days, ito ay nakasaad sa kontrata or sa company rules and regulations at hindi sa batas paggawa ng kaharian.

      Ang tungkol sa Sick Leave, ito po ay makikita sa Saudi Labor Law Art. 117: A worker whose illness has been proven shall be eligible for a paid sick leave for the first thirty days, three quarters of the wage for the next sixty days and without pay for the following thirty days, unless both parties agree otherwise. A single year shall mean the year which begins from the date of the first sick leave.

      Explanation:

      Sick leave – continuous or intermittent during a single year & illness has been proven.

      – 1st 30 days- full-pay
      – next 60 days- 75% of wage
      – following 30 days- no pay

      May right kayong habolin ito, just make sure lang na nag comply kayo sa nakasaad na “been proven“, kaya kung pupunta kayo ng clinic or hospital huwag mahiyang hingin ang findings or mga dokumento na nagpapatunay na kayo ay may sakit.

  7. sir, gandang hapon po! hindi po nakasulat sa contract nmn kung mahal ang ticket ay hindi na po kami pauuwiin o madedelayed na po. gusto po nila ako maghintay ng 3 months or hanggang sa magmura ang ticket daw po. ayaw po nila magbayad ng ticket na aabot po ng 3k sr..dapat daw po nasa range lang ng 2800 ang pinaka mataas na po iyon. dahil po sa hindi pa po sila nakapa book ng ticket ko hanggang ngayon mas lalo pong madedelayed ang bakasyon ko po at gusto ko na pong makauwi sir…
    anu po ba ang aking gagawin sir para kumbinsehin sila na pauwiin ako? sinabi po kasi ng aming executive manager ay according daw po sa Saudi law ay may rigt daw po ang employer sir na kung kelan niya ako gusto ipabakasyon ay dun lang daw po ako pwedeng magbakasyun..hanggang kelan po ba ako maghihintay sa nasabing bakasyon??? marami po salamat sa pagreply nyo po sa aking mensahe…God bles u more!

      He he! Ginamit pa ang Saudi Labor Law ha para mabinbin ang uwi mo. Totoo meron pong provision sa SLL tungkol sa LEAVE ng manggagawa pero hindi naman valid reason ang ‘MAHAL ANG TIKET AT MAGHINTAY BAGO BUMABA”. The said provision of the SLL they mentioned is as follows:

      Article 10. 2. A worker shall enjoy his leave in the year it is due. He may not forgo it or receive cash in lieu during his period of service. The employer may set the dates of such leave according to work requirements or may grant them in rotation to ensure smooth progress of work. The employer shall notify the worker of the date of his leave in sufficient time of not less than thirty days.

      Hindi ang halaga ng tiket ang pinag-uusapan dito kundi ang trabaho – according to work requirements.

      Well, kung gusto mo talagang umuwi or uwing uwi ka na, wala tayong choice kundi bayaran mo na ang halagang sobra ng SAR 2,800.00 kaysa naman mas lalo kang di makauwi dahil lalong magmahal ang tiket pag malapit na ang gusto mong departure date. So ngayon pa lang dapat ma purchase na ang tiket at least medyo mura pa at may bakante pa. Akala ko ang kuripot sa mundo ay Ilocano lang at Boholanong katulad ko, pati rin pala SAUDI.

      Nasa sa iyo iyon at ikaw lang ang makapag desisyon nito.

  8. sir gusto ko lang po magtanong regarding po sa aking nsasabing vacation leave po… kasi po dapat po sana ay magbabakasyon po ako nung june 20 eh hindi po natuloy dahil po sa iqama ko ay delayed dumating.tapos po ngayon po nanasa akin na ang iqama ko ay complain naman po nila ay mahal po raw ang ticket which cost 3020sr po wich our company cant basically pay dahil mahal daw po ang tiket… dhil po sa kagustuhan ko na umuwi ngayong july 05,2011 ay sinabi ko po sa executive manager ng company nmn n wiling ako magpay ng 200-300sr po pra lang po mkapagbkasyon po ako…may right po ba ako sir n magbakasyon na hindi na magbabayad para madagdagan ang cost ng ticket ko? kasi peak season daw po nagyon pero po kelangan ko lang po talaga makauwi as soon as possible pero sinabi po sa skin pag nagmura po raw ang ticket..anu po ba ang aking gagawin? anyweis sir gusto ko lang pong sabihin na hindi po maganda ang pamamalakad ng aming kompanya at my record na po sila sa hindi magandang pamamalakad…tnx po!       Check you contract pag walang nakasaad na amount sa tiket na dapat bayaran ng employer, ibig sabihin kahit gaano kamahal ang tiket ay dapat nilang bilhin para maka-uwi or makapagbakasyon ang worker ayon sa takdang araw .

      Peak season ng mga ibang lahi hindi sa Pinoy. Ang peak season ng mga pinoy ay December at March.

      Hindi nga talaga maganda ang inyong kompanya, sa pinapakita lang nila tungkol sa halaga ng ticket, ay dapat naka RED category na ang mga ito.

    good day po,nais ko lang po na i konsulta ang kinakaharap naming problema dito sa kompanya namin, nangangamba po kami sa di magandang pag trato sa amin ng boss namin, kadalasn po ay gumagawa sya ng problema para lang may dahilan sya na kaltasan ang sweldo namin,at kapag nag paalam naman po kami na mag exit ay gumagawa po sya ng problema kagaya ng kasamahan ko na nagpaalam mag exit ginawan po sya ng istorya at ipinakulong,ayaw ko po sana na maranasan namin ang ganon, sakali pong matapos na namin ang kontrata namin ay nais na po naming mag exit pero kinakabahan po kami na baka gawan nya kami ng problema,ano po ang aming magandang gawin? maari po ba na bago kami mag file for exit ay ipaalam muna namin sa polo? upang sakaling may mangyari ay alam na nila? at isa pa po papano kung di bayaran ang aming end of contract payment ano po ang aming gagawin? 4 years napo kami dito. pag payuhan nyo po ako salamat po more powerand god bless you.

    • Leo,

      Ang pagkaltas sa sahod na walang basihan at hindi alam ng worker ay isang paglabag sa SLL. Huwag matakot dahil nasa atin ang batas. Please take note of the below SLL Articles:

      Article 72: The worker shall be notified in writing of the decision of imposing the penalty on him. If he refuses to receive the same or if he is absent, the notice shall be sent to the address shown in his file by registered mail. The worker may object to the decision of imposing the penalty upon him within fifteen days, excluding official holidays, from the date of notifying him of the final decision. The objection shall be filed with the Commission for the Settlement of Labor Disputes which shall be required to issue its decision within thirty days from the date of registering the objection.

      Article 73: Fines imposed on the workers shall be entered in a special record, showing the worker’s name, his wages, the amount of the fine, reasons and date of the fine. Such fines may not be disposed of except for the benefit of the firm’s workers, upon the Ministry’s approval.

      Pakisama na rin ang Art. 92 : No amount shall be deducted from the worker’s wages against private rights without his written consent…and 93: In all cases, deductions made may not exceed half the worker’s due wage, unless the Commission for the Settlement of Labor Disputes determines that further deductions can be made or that the worker is in need of more than half his wage. In the latter case, the worker may not be given more than three quarters of his wage.

      At walang multa or penalties na daapt ipatupad kung hindi ito ipinagtibay o dumaan o aprobado ng Ministry of Labor.

      Ibig sabihin puwede po ninyong kasohan ang inyong employer sa Saudi Labor with the assistance of our POLO.

      Pero tama ka, dapat humingi muna ng payo sa ating POLO at ilahad ang inyong mga worries at magtanong kung ano ang dapat gawin.

      Lastly, dapat mapasainyo ang dapat para inyo. Ang ESB ay dapat ibigay sa mga worker ayon sa pagsunod sa Batas Paggawa ng kaharian.
