Section Four: End-of-Service Award

Article 84
Upon the end of the work relation, the employer shall pay the worker an end-of-service award of a half-month wage for each of the first five years and a one-month wage for each of the following years. The end-of-service award shall be calculated on the basis of the last wage and the worker shall be entitled to an end-of-service award for the portions of the year in proportion to the time spent on the job.

Article 85
If the work relation ends due to the worker’s resignation, he shall, in this case, be entitled to one third of the award after a service of not less than two consecutive years and not more than five years, to two thirds if his service is in excess of five successive years but less than ten years and to the full award if his service amounts to ten or more years.

Article 86
As an exception to the provision of Article (8) of this Law, it may be agreed that the wage used as a basis for calculating the end-of-service award does not include all or some of the commissions, sales percentages, and similar wage components paid to the worker which are by their nature subject to increase or decrease.

Article 87
As an exception to the provisions of Article (85) of this Law, the worker shall be entitled to the full award if he leaves the work due to a force majeure beyond his control. A female worker shall likewise be entitled to the full award if she ends her contract within six months from the date of her marriage or three months from the date of giving birth.

Article 88
Upon the end of the worker’s service, the employer shall pay his wages and settle his entitlements within a maximum period of one week from the date of the end of the contractual relation. If the worker ends the contract, the employer shall settle all his entitlements within a period not exceeding two weeks. The employer may deduct any work-related debt due to him from the worker’s entitlements.

  1. with your due respect sir i have been here for 2003 till present and end contract next yr 2017 MAY .our HR TOLD THAT the ESB im taking already every end of two years contract basic only is that the ESB for my 14 yrs service in the KINGDOM sir i need your opinion so that know whom im going to seek LEGAL OFFICE in this country in case im still have my ESB BY THE WAY sir im a registered filipino nurse working in private institution pls help me

    • Kung sinabing nakuha mo na ang ESB every 2 years, tingnan nyo po kung may dinagdag ba na amount sa inyong nakukuha tuwing natapos mo ang iyong 2 taon. Halimbawa, amount aside from the paid leaves. check mo rin kung may pinirmahan ka bang dokumento tuwing matanggap mo ang iyong mga benefits every 2 years.

      Kung wala kang natangap na halaga maliban sa leave pay, puwede mong ireklamo ang employer sa Ministry of Labor.

Nag abiso po ako sa amo ko na tatapusin ku na lng po ang 11 months n natitira s kontrata ko para d po sila umasa na mag stay aku dto dahil may offer n po ako sa ibang bansa sa tulong ng kaibigan ko. Nababahala lng po ako na baka ipitin o hindi nila ako pauwin. Kung magkagayon anu po dapat kong gawin. Tnx po.

        • Dapat lamang na pauwiin ang worker pag tapos na ang kontrata at ayaw na itong e-renew. Idaan sa proseso, 60 days written notice bago matapos ang kontrata. Ipa receive mo ang notice sa inyong HR or manager. Kung ayaw tanggapin, ipadala by registered mail and keep the receipt. Pag di ina-aksyonan, mag file ng complaint sa Saudi LAbor office, bring with you the letter notice or the registry receipt of the notice of non-renewal of contract.

      • Sir wala po nadadag sa leave paid ko then my PIRMA po KADA received lng ng 2 months leave paid at sir kung mg resign po ba ako my makukuha po ba akong ESB kung di ko po MATAPOS contract ko by 2017 kung UUWI N po ko for example by DECEMBER RESIGN MY RIGHTs and privileges pa po ako salamat po ..GOD BLESS SANA MABGYAN NYO PO KO NG INYONG IDEAS

        • Ang leave pay po ay katumbas sa araw o isang buwan ng iyong bakasyon, example 21 days or 30 days leave pay. Kung dalawang buwan ang iyong natanggap, maaaring ang isang buwan na pay ay katumbas sa iyong ESB. Linawin mo po sa inyong kompanya. Pero, bawal pa rin sa batas ang kanilang polisiya. Puwede kang mag reklamo sa Saudi Labor Office.

  2. Sir,12 yrs na ako sa company at nag apply na ako for exit.Gusto ko lang pong malaman ang legal na computation sa ESB…Sinabihan kasi ako ng accountant namin na sa Basic lang daw icocompute? Meron kasi akong Food At Housing Allowances na tinatanggap ko monthly kasabay ng Basic Salary ko po…

    • Kasama po sa kalkulasyon ang Food at Housing allowance ayon sa batas at dapat kakalkulahin base sa huling antas ng suweldo (basic pay).

      Ang kalkulasyon ay binabasihan rin sa type of contract whether fix or indefinite or unspecified and reason for the end of service.
