  1. Ask ko lng po kung may bbayaran ako kung di ntapos ang kontrata kc magttwo months plng po ako and gusto ko nang umuwi..at magkano nman po kung meron.andito po ako sa bahrain ngaun!!reply asap

    • Sa susunod huwag kayong mangibang bayan kung hindi po kayo sigurado sa inyong desisyon. Hindi ko po alam kung magkano. Itanong nyo po sa inyong employer.

      Check if your contract has a provision about probationary period. If does read the below BLL.

      Bahrin Labor Article 41: The conditions of employment of a worker to be employed under probation, if it is to be part of the contract, shall be recorded in writing therein and signed by the parties thereto provided that the period of probation shall not exceed three monthsxxxxxxxxxxxx Either of the parties may terminate a contract of employment during the probationary period if it becomes evident that its continuance is not suitable provided that the party terminating the contract gives one day’s notice to the other party.

      Bahrain Labor Law Article 109: When the worker is the offending party, for cause other than those prescribed by Article 115 of this Law, he shall be liable to pay to the employer concerned compensation for the loss incurred as a result of such termination of the contract.

  2. Good day po. First contract ko po. Food runner po work ko. (Restaurant?) Ngayong July 27, 2016 ang tapos ng kontrata ko. Pero i-extend daw po ako sa iqama. Oct.2, 2016 expired ng iqama. Ano po bang pwedeng paraan para pauwiin ako ng mismong kontrata? Salamat po.

    • Malinaw na nasa definite contract ka or fix contract dahil hindi ka pa nakapag-renew ng kontrata. Ibig pong sabihin kung nagtatapos ang kontrata at sinang-ayonan ng both parties na tapusin na ito, ito ay magtatapos sa kanyang expiry date – SLL Art. 74.

      Dapat pong idaan sa proseso ang pag notisya sa employer “Notice of Non-Renewal of Contract” 60 days prior expiration date of the contract as per Saudi Labor Law.

      Dapat pong ma comply ang notisya para walang rason ang employer na ipagpaliban ang iyong pag-uwi kagaya ng walang kapalit at kailangan ka sa iyong puwesto.

    • May karapatan na pauwiin ka ng iyong employer kung nakikitang hindi ka suitable for the job or fit for the job during the probationary period.

      Makipag-ugnayan ka sa iyong recruitment agency para ikaw ay mapalitan at ma process ang iyong repatriation. Puwedeng gastosan ng employer or ng recruitment agency ang iyong travel expenses. Depende sa kanilang pinirmahang recruitment agreement kung sino ang gagastos sa iyong repatriation either due to your fault or employer’s fault.

      According to the POEA Rules and Regulations:

      Who has the primary responsibility to repatriate the overseas Filipino workers?

      Answer: The repatriation of an Overseas Filipino Worker or his/her remains, and the transport of his/her personal effects shall be the primary responsibility of the principal/employer and licensed recruitment agency that recruited and/or deployed him. This entails the obligation to cover repatriation and attendant costs, including airfare and immigration fines/penalties. This obligation shall be without prior determination of the cause of the need to repatriate the Overseas Filipino Worker. After the Overseas Filipino Worker has returned to the country, the principal/employer or licensed recruitment agency may, however, recover the cost of repatriation from the Overseas Filipino Worker if the termination of the employment was due solely to the Overseas Filipino Worker’s fault. (Section 213)

  4. hi po buntis po kase kapatid ng asawa ko galing sa baksyon at nalang nya na buntis sya pagdating dito sa abudabi.at ngayon nalanmn ng amo nya at pinagbabayad sya sa visa na ginastos nya ligal poba talaga na singilin pa sya sa visa nya?

    • Pregnancy out of wedlock is illegal or is a crime in the UAE. Out of wedlock because her husband is not with her even they’re legally married in PHL. So, the employer got panic, asking the pregnant worker to go back to her country kaysa pag salohan ng employer ang problema ng worker. The employer will then ask the worker to compensate them the amount of the visa incurred sa pagkuha sa kanya sa Pilipinas. May karapatang humingi ng kabayaran ang employer, pero hindi po ito batas kundi discretion of the employer.

      Payo ko, kausapin muli ang employer baka naman maintindihan nila ang kanyang situwasyon. Or ask guidance with our Embassy/POLO/OWWA in Abdu Dhabi.

    • May karapatan ang employer na hingan ng kabayaran ang worker sa hindi pagtatapos ng kanyang kontrata. Sa concern ng inyong Ttia, hindi nga niya kasalanan ang namatayan ngunit may kontrata po siyang dapat taposin. Mahirap man ang mawalan ng mahal sa buhay pero may obligasyon siyang dapat tuparin. Pero ang payo ko kausapin nya uli ang kanyang employer na kahit ang pamasahe man lang pabalik sa Pinas at pabalik sa KSA. Pangalawa puwede niyang kausapin ang recruitment agency sa Pilipinas.

  6. Tanong ko lng po kung anu dpat gawin para magsama kmi ng legal ng asawa ko d2 sa saudi.. Kasi ung asawa ko ppnta xa d2 magtratrabaho as a beautician.. Plano nmin magsama sa bahay at pumayag nman ung amo nya gnun din nman sakin.. Anu kaya dapat nmin gawin.

    • Wala po akong ideya kung magkano pero ang alam ko may karapatan ang employer para humingi ng kabayaran sa worker sa hindi pagtatapos ng kontrata or kung kinansela ng worker ang kontrata na walang basihan.
